Terms of service

Last updated: 26 October 2026

1. Scope

These terms govern the use of overpass.ch (the “Service”), provided by Chavdar Dutsov, Spycherweg 3, 5223 Riniken, Switzerland (“we”, “us”), by its customers (“you”). By creating an account or using the Service you accept these terms. Deviating terms of customers do not apply.

2. The Service

The Service provides access to an Overpass API server containing OpenStreetMap data, to an elevation API and to map tiles (vector map tiles, map styles and terrain tiles), through personal API keys, within the limits of the plan you choose (see pricing). The Elevation plan includes the elevation API only; the Maps plan includes map tiles and the elevation API, without the Overpass API. We provide the Service with professional care but without a guaranteed availability. Maintenance, updates of the database, technical faults and events outside our control can cause interruptions. Where possible we announce planned maintenance on the status page.

We may develop the Service further, change technical details and adjust plan limits, provided the essential functions of a paid plan are not reduced during a paid period.

3. Account and API keys

  • You must provide accurate information and keep your e-mail address current. One account per person or organisation; you must be at least 18 years old or act for an organisation.
  • You are responsible for keeping your password and API keys secret and for all use made with your keys. Revoke a key immediately if it may have been exposed.
  • Limits apply per account. Creating several accounts to get around limits is not permitted.

4. Plans, prices and payment

  • The free plans are free of charge. They are for evaluation and development, and for personal, educational and non-profit projects. Production use by a business, a website or app that earns money through sales, subscriptions or advertising, and work for a paying client need a paid plan. Accounts created before 27 October 2026 may continue to use the free plans commercially. We may change the limits of the free plans or discontinue them with reasonable notice.
  • Paid plans are billed in advance, monthly or yearly, in CHF, EUR or USD, at the prices shown when you subscribe. Subscriptions are sold through Link (Sold through Link, LLC, a Stripe company), which acts as reseller. Link takes the payment, adds the VAT, GST or sales tax due in your country and sends the invoice; its terms apply to the purchase. The prices shown exclude these taxes.
  • Subscriptions renew automatically for the same period until cancelled. You can cancel at any time in your dashboard; the cancellation takes effect at the end of the current period, after which your account moves to the free plan. Paid fees are not refunded, except where the law requires it.
  • Upgrades and downgrades take effect immediately; the difference is prorated.
  • If a payment fails, we retry for several days. If it still fails, your account moves to the free plan.
  • We may change prices for future periods. We tell you by e-mail at least 30 days in advance, and you may cancel before the change takes effect.
  • There are no overage fees: when a monthly allowance (Overpass requests, elevation lookups or map tiles) is used up, requests of that kind are rejected until the next month or an upgrade. We send an e-mail when 80% and when 100% of an allowance are used.

5. Acceptable use

You must not:

  • use the Service for unlawful purposes or in breach of third-party rights;
  • circumvent limits, keys, referer restrictions or other technical measures, or probe, scan or attack the Service;
  • resell or sublicense raw access to the Service, or publish unrestricted API keys (if you use a key in a public web page, use a key of the type “Maps only” or set Allowed referers for it and tick “Reject requests without a referer”; do not publish keys anywhere else, for example in code repositories);
  • download map tiles in bulk, keep copies of them beyond the normal cache of a browser or app, or show them without the attribution that the styles include;
  • place excessive load on the Service beyond normal use of your plan (for example automated planet-wide scans that are better served by data extracts).

We may throttle or suspend access that endangers the Service or breaches these rules. Where reasonable we warn you first.

6. Data and licence

The data is © OpenStreetMap contributors and licensed under the Open Database Licence (ODbL). You are responsible for complying with the ODbL when you use, display or publish the data, in particular attribution (“© OpenStreetMap contributors”) and share-alike for derived databases. The data is created by volunteers; we give no warranty that it is complete, correct or current.

Elevation data. The elevation API answers from the Copernicus WorldDEM™-90 (Copernicus DEM GLO-90) on land and from the GEBCO grid at sea. When you publish, display or distribute elevation results, you must

  • credit the land data with the notice “produced using Copernicus WorldDEM™-90 © DLR e.V. 2010-2014 and © Airbus Defence and Space GmbH 2014-2018 provided under COPERNICUS by the European Union and ESA; all rights reserved”, and the sea data as “GEBCO Compilation Group (2026) GEBCO 2026 Grid”;
  • include in your own licence or legal notice the sentence: “The organisations in charge of the Copernicus programme by law or by delegation do not incur any liability for any use of the Copernicus WorldDEM™-90”;
  • not give the impression that your activities are endorsed by the European Union, ESA, Airbus Defence and Space, DLR or GEBCO; and
  • bind anyone you allow to redistribute the results to these same obligations.

Elevation and depth values are approximations for general purposes. They must not be used for navigation or for safety-critical purposes.

The vector map tiles are a Produced Work under the ODbL, made from OpenStreetMap data and Natural Earth with the tools of Protomaps. Maps that show them must display “© OpenStreetMap”; the styles include this attribution, and you must keep it visible. The styles are licensed under the BSD and CC0 licences, the icons under the MIT licence and the fonts under the SIL Open Font Licence. The tiles also contain a landcover layer derived from ESA WorldCover (CC BY 4.0), which our styles do not show; if you display it, credit “© ESA WorldCover project 2020 / Contains modified Copernicus Sentinel data (2020) processed by ESA WorldCover consortium”. The terrain tiles are derived from the Copernicus WorldDEM™-90: maps that show them must display the Copernicus notice (the terrain TileJSON includes a short form that links to the full notice), and the obligations for elevation data above apply to them.

7. Liability

We are liable without limitation for damage caused intentionally or through gross negligence. Otherwise, to the extent permitted by law, our liability is excluded, in particular for indirect or consequential damage, lost profit and data loss, and limited in total to the fees you paid in the twelve months before the event giving rise to the claim. Mandatory statutory liability remains unaffected.

8. Term and termination

You may delete your account at any time in your dashboard. We may terminate a free account by notifying you 30 days in advance, and a paid account at the end of a billing period, also notifying you 30 days in advance. Either party may terminate without notice for good cause, in particular for serious or repeated breaches of section 5.

9. Privacy

How we handle personal data is described in the privacy policy.

10. Changes

We may change these terms. We announce material changes at least 30 days in advance by e-mail. If you do not object before they take effect, the new terms apply. If you object, either party may terminate the contract when the change takes effect.

11. Governing law and jurisdiction

These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the registered office of the operator, subject to mandatory places of jurisdiction for consumers.
